On the basis of Article 13 sec. 1-2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (Journal of Laws No. UE L2016, No. 116) - hereinafter referred to as GDPR

Part I. We hereby inform about the rules for the processing of personal data by us from the data subject, effective from 25 May 2018 regarding:


1. The administrator of your personal data, and therefore the entity that processes the personal data, is Heverc Spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office in Łubianka at ul. Polna 4a, 87-148, entered into the National Court Register (KRS) kept by the District Court in Toruń, VII Commercial Division, under KRS number 0000566165, hereinafter referred to as the "Administrator".
2. Please be advised that we have not appointed a personal data inspector. Please contact the Administrator at biuro@heverc.pl in matters relating to the protection of personal data, and refer to the privacy policy available on the Administrator's website www.heverc.pl

3. Please be advised that in connection with the cooperation between us and the conclusion of the contract (which is understood as also taking steps before the conclusion of the contract and its implementation), we process the following personal data: your name, surname, address, telephone number, e-mail address, NIP (Polish tax ID), REGON (Polish statistical number).


4. Please be advised that your personal data will be processed for the following purpose and based on the following legal basis:
- the provision of Art. 6 sec. 1(b) GDPR, i.e. the processing of personal data is necessary for the performance (activities preceding the conclusion, the conclusion, performance) of the contract to which we are parties,
- the provision of Art. 6 sec. 1(c) GDPR to the extent that the processing of your personal data is necessary to fulfill the legal obligation incumbent on us and resulting from applicable law, including tax obligations and administrative obligations,

- the provision of Art. 6 sec. 1(f) of GDPR, and therefore our legitimate interest in determining, investigating and defending claims related to contracts concluded between us related to debt collection, debt recovery, as well as using the services of data recipients,

- the provision of Art. 6 sec. 1(a) GDPR, and therefore marketing and promotional activities in the case of conducting marketing activities in your respect, including through the Newsletter,

5. The recipients of your personal data are companies that provide services to us, i.e. courier companies, transport or postal services, marketing companies, providers of the IT industry and IT services and solutions, entities providing photographic and audiovisual services, entities providing accounting services, law firms, debt collection companies, public bodies and institutions.


6. Your personal data will be processed by us throughout the duration of the contract and its performance, as well as in the period thereafter until the expiry of the limitation periods for any claims related to the contract and the fulfillment of legal obligations, or until you withdraw your consent to their processing.


7. We would also like to inform you that in connection with the processing of your personal data by us, you have the right to access this data, rectify it, delete it or limit its processing, as well as the right to object to the processing and the right to transfer personal data. You have the right to lodge a complaint with the supervisory authority.


8. You retain the right to withdraw your consent to data processing at any time if the basis for data processing is the provision of Art. 6 sec. 1(a) GDPR.

9. We would like to point out that the provision of your personal data referred to in point 3 remains voluntary. Failure to provide certain personal data will prevent us from providing you with electronic services, concluding contracts, or undertaking marketing or promotional activities.

10. We also inform that the Administrator does not use automated processing of personal data, including profiling.

Part II. If this applies to you, please refer to the information clause regarding the processing of personal data of natural persons by us, representing our contractor and natural persons indicated as contact persons/coordinators/persons responsible for the performance and cooperation with us in connection with the cooperation and performance of the contract between us.


1. Be advised that we process the following personal data: name, surname, business telephone number, position, place of work, business address, e-mail address, i.e. personal data in the category of contact details in connection with the cooperation between us and the implementation of the contract.


2. The personal data indicated in point 1 are to be obtained from our contractors, persons with whom we conclude contracts and they relate to you as natural persons representing our contractor or you have been indicated as contact persons, cooperation with us in connection with concluded contracts, as well as services provided.

3. Your personal data is processed only for the purpose and scope necessary for the performance of the Administrator's tasks related to the performance of concluded contracts and provided services. The basis for such processing of personal data is art. 6 sec. 1(f) GDPR, and therefore our legitimate interest. The processing of your personal data may be necessary to fulfill the legal obligation incumbent on us and resulting from applicable law, and the legal basis for such action is art. 6 sec. 1(c) GDPR.


4. Be advised that your data will not be transferred to recipients of personal data, unless the necessity to transfer it will result from the performance of concluded contracts or performance for entities from which we have received services. The recipients of your personal data may also be public administration bodies, including tax authorities and accounting services, entities providing accounting services, law firms, and debt collection companies.

5. Be advised that the indicated personal data is not transferred to a third country or an international organization.

6. The personal data referred to in point 1 are stored only for the period necessary for the implementation of contracts concluded between us, the provision of services, and following this period the data will be stored for the purpose of investigating or defending against claims that may arise in connection with the performance of the contract related to provided services, as well as performing obligations resulting from legal regulations, in particular tax, administrative and archiving regulations.


7. Be advised that in the case of obtaining this data in a different way other than from the data subject, the persons whose personal data are obtained and processed in this way have the rights referred to in Part I point 1, 2, 7, and 9.

8. We oblige our contractor to inform natural persons to whom this clause applies about its personal data protection content and principles applied by us.

Cookie Policy

Anonymity
Internet users using our website remain anonymous until they decide otherwise. Most of the resources collected on the website do not require leaving any information about yourself, allowing you to freely navigate throughout the site.

Types of cookies used
Cookies used by the Administrator are safe for the User's Device. In particular, it is not possible for viruses or other unwanted software or malware to enter Users' Devices in this manner. These files allow you to identify the software used by the User and adjust the Website individually to each User. Cookies usually contain the name of the domain they come from, the storage time on the Device and the assigned value.

The administrator uses various types of cookies:
Session cookies: they are stored on the User's Device and remain there until the end of the browser session. The stored information is then permanently deleted from the memory of the Device. The mechanism of session cookies does not allow the collection of any personal data or any confidential information from the User's Device.
Persistent cookies: they are stored on the User's Device and remain there until they are deleted. Ending a browser session or turning off the Device does not delete them from the User's Device. The persistent cookie mechanism does not allow the collection of any personal data or any confidential information from the User's Device. The User has the option to limit or disable the access of cookies to their Device. If you use this option, using the Website will be possible, except for functions which, by their nature, require cookies.

The purposes for which cookies are used
The administrator uses his own cookies in order to correctly configure the website, in particular to adapt the content of the Website pages to the User's preferences and to optimize the use of the Website pages; recognizing the device of the Website User and properly displaying the website, tailored to their individual needs.

Security
The website is equipped with security measures to protect the data under our control against loss, misuse and modification. Only a limited number of authorized employees have access to personal and address data. An advanced authorization management system oversees access to information, which, combined with the encryption of selected data in the database, protects against unauthorized access.

The website may contain links to other websites that are independent of us and are not under our control. We provide them only for the convenience and information of Users. These websites may have their own personal data protection rules, so we encourage you to exercise caution when leaving our website and to read the privacy policies of any other website that collects personal data. We are also not responsible for the information presented on such websites or for other activities carried out through them.

Consent
By using the website, you consent to the conditions set out in this Privacy Policy and to the processing of personal data by the domain owner provided by the User for the above-mentioned purposes or for purposes specified in the content of the pages, and additionally to the terms of use of the Google Analytics service and data processing rules in accordance with GDPR requirements.
